Ranchi, December 05, 2024: The Jharkhand High Court has concluded its hearing on a petition challenging the arrest of Amit Kumar Agrawal, an accused in the illegal purchase and sale of 4.55 acres of land under Army control. The bench reserved its decision after hearing arguments from both sides on Thursday.

Petition Details and Legal Representation

Amit Kumar Agrawal’s petition contests his arrest on June 7, 2023, arguing that the Enforcement Directorate (ED) failed to provide written reasons for his detention. Amit Kumar Agrawal has demanded his release, deeming the arrest unlawful.
Senior Supreme Court advocate Minakshi Arora, along with High Court advocates Rohit Ranjan Sinha, Abhishek Agrawal and Amrita Sinha, represented the petitioner in court.

ED’s Case and Allegations

The ED filed ECIR 1/2023 against Amit Kumar Agrawal, Chhavi Ranjan and eight others in connection with the land scam. According to court documents, an FIR numbered 141/2022 was registered at Bariatu police station, implicating the accused in fraudulent transactions involving Army land. The agency has also filed a charge sheet in court against the accused.

Context of the Land Scam

The case revolves around the illegal purchase and sale of land measuring 4.55 acres, reportedly under Army control, in Ranchi’s Bariatu area. Authorities allege that Amit Kumar Agrawal, in collaboration with others, orchestrated the fraudulent transactions. The case has attracted significant attention due to its implications on land governance and administrative integrity in the state.

Arguments by the Petitioner

Amit Kumar Agrawal’s defense claims procedural lapses during his arrest, stating that the ED failed to inform him of the grounds for detention in writing. Legal experts representing the petitioner argue that these omissions render the detention invalid under legal provisions.

Next Steps in the Case

With the High Court reserving its verdict, the focus now shifts to its decision, which could set a precedent for handling similar cases of alleged procedural violations by investigative agencies.

Wider Implications

This case is part of a broader crackdown on corruption in Jharkhand, particularly in land-related cases. It highlights systemic issues in land acquisition and the alleged misuse of administrative positions by public officials and private entities.
