Ranchi, November 08, 2024: The Supreme Court on Friday issued a notice to the Central Government concerning the issue of Bangladeshi infiltration in Jharkhand’s Santhal region. The notice follows the state government’s petition challenging the High Court’s order to investigate the matter. The case was heard by a bench consisting of Justice Sudhanshu Dhulia and Justice A. Amanulla. The top court has scheduled the next hearing for December 3, 2024.

Background: Jharkhand’s Bangladeshi Infiltration Case

The state government’s petition challenges the High Court’s order that instructed both the Central and State governments to form a fact-finding committee to probe the alleged infiltration of Bangladeshi nationals into the Santhal region. The High Court had also ordered the authorities to submit the names of two officials to head the committee by September 30. However, the Supreme Court has directed that no names should be suggested for two weeks, delaying the proceedings further.

Bangladeshi Infiltration Allegations

The case was brought to the High Court by Jamshedpur resident, Daniyal Danish, who filed a public interest litigation (PIL) highlighting the infiltration of Bangladeshi-origin people in the Santhal region. In his petition, he raised concerns about the increasing number of non-indigenous populations in the region, particularly focusing on the implications for the local tribal communities.

Government’s Response

In response to the allegations, the Central Government submitted an affidavit stating that the tribal population in the Santhal region has significantly decreased over time. It claimed that land in the area is being distributed to Muslims through “gift deeds.” The affidavit further detailed that the Christian population in the region has witnessed a substantial rise, while the tribal population has decreased from 44% to just 28% in recent years.

Demographic Shifts and Concerns

The Center’s response drew attention to the changing demographics of the region, noting that the shrinking tribal population poses a serious concern for the indigenous communities. The Central Government also cited this demographic shift as a contributing factor to tensions surrounding land ownership and the preservation of tribal rights.

Impact on Tribals and Indigenous Rights

The issue of Bangladeshi infiltration raises significant questions about the protection of tribal rights in Jharkhand. Advocates argue that the influx of migrants has led to the marginalization of the local tribes, exacerbating the challenges faced by these communities in terms of land rights, employment and social security. There are growing concerns that the presence of large numbers of non-tribal populations may lead to an erosion of the cultural and socio-economic fabric of the indigenous communities.

Political and Social Implications

This case has not only legal but also political ramifications. The infiltration issue has become a point of contention in the state, with local political leaders, including those from tribal groups, demanding stronger actions to protect their interests. The decision of the Supreme Court to issue a notice to the Central Government has escalated the matter, bringing it into the national spotlight.

Next Steps: Jharkhand’s Bangladeshi Infiltration Issue

With the next hearing scheduled for December 3, the Supreme Court will examine the responses from both the state and central governments, as well as the possible formation of the fact-finding committee. This will be a pivotal moment in determining the course of action regarding the allegations of Bangladeshi infiltration in the Santhal region and its broader implications for tribal communities.

The ongoing case serves as a reminder of the delicate balance between immigration, demographic changes, and the protection of indigenous rights, with far-reaching consequences for both local communities and the nation’s legal framework.
